The Senate Committee on Education Tuesday unanimously approved SB 132 by Texas State Senator Jane Nelson, R-Flower Mound, to clarify that Texas school districts may not require teachers to artificially inflate a student’s grade, including report card grades or other cumulative averages of a student’s individual grades.
In 2009, the Legislature unanimously passed Senate Bill 2033, prohibiting minimum grade policies in schools. Following a lawsuit, a Travis County judge ruled that the law clearly applies to all student grades. Senate Bill 132 codifies that ruling.
“This legislation affirms the authority of teachers to assign grades that their students have earned,” said Senator Nelson. “As a former teacher, I strongly believe that students should be graded based on the merit of their work, not according to an artificial minimum.”
